45-A District Court

The 45-A District Court has jurisdiction in general civil litigation matters up to $25,000 and in small claims matters of $3,000 or less. The court also hears cases involving garnishment proceedings, evictions, land contract disputes and mortgage foreclosures.

Arraignments and preliminary exams for felony cases are heard in the 45-A District Court, as are bench trials, jury trials, and sentencing on all misdemeanor cases. The court also sets bonds and issues search warrants in criminal matters.

Traffic Violations

All traffic cases violations (civil infractions and traffic misdemeanors) occurring in the City of Berkley are heard in the 45-A District Court.

Meet Your Judge:



The Honorable
William R. Sauer

Judge Sauer has been the City of Berkley’s District Court Judge since 1990 and is presently serving his third term in office. Prior to his election as Judge, he maintained a law office in Berkley and also served on the Berkley City Council.

Judge Sauer is a member of the Oakland County Bar Association where he is the former Chairperson of the District Court Committee and a member of the American Bar Association. Judge Sauer graduated from Michigan State University and received his law degree from Detroit College of Law.

Judge Sauer has been a Berkley resident since 1976 and has been married to his wife Martha for 36 years; they have one son, Christopher, who is presently teaching school in Florida.

 

Meet Your Magistrate & Court Administrator:

John Michael Zychowski is both the magistrate and court administrator at the 45-A District Court. As the court administrator, he is responsible for personnel management, fiscal management and all other administrative functions of the court. As the magistrate, Mike conducts arraignments on criminal matters prior to trial and sets bond. He hears small claims cases and holds informal hearings on civil infractions and traffic matters.

Prior to becoming the District Court administrator in 1995 and the magistrate in 1999, Mike served as the Berkley City Attorney from 1993 to 1995. Mike graduated from Wayne State University and received his law degree from Detroit College of Law.

He has been married to his wife, JoAnn, for nearly 35 years.
