City of Berkley and Vinsetta Garage Parking Consent Judgment to Be Voted on at the City Council Special Meeting Set for January 23, 2020

Berkley, MI – January 17, 2020 – After hearing the concerns of residents at the January 6, 2020, city council meeting, the City of Berkley and City Council worked with 27799 Woodward LLC on clarifying the consent judgment language surrounding the Planning Commission’s role.
The updated language clarifies that the proposed Oxford parking lot and its perimeter wall materials and construction are subject to the Planning Commission site plan review and approval process, in accordance with the consent judgment and city ordinances.
The consent judgment specifically states, “Prior to commencing any construction of the Oxford parking lot on parcels 25-17-431-023 and 022, Plaintiff must apply for and obtain site plan approval from the City Planning Commission in accordance with the City’s Zoning Ordinance. The scope of the City Planning Commission’s site plan review shall be to determine whether Plaintiff’s site plan is consistent with this Consent Judgment and applicable City ordinances.”
This judgment will be considered by City Council at the special city council meeting on Thursday, January 23, 2020, at 7 PM in the City Council Chambers.
If the case settlement is not approved, the case will proceed in court toward a final determination by the Circuit Court Judge which, if the Plaintiff prevails, could result in the 4 lots on Oxford being approved for parking and an award of money damages against the City, or conversely, with maintaining the residential zoning of the lots, the vacant houses, and the substandard parking conditions if the City prevails in court.
Following the special meeting, should the consent judgment be approved, it would be submitted to the court for final approval.
