NOTICE OF PUBLIC HEARING
BERKLEY ZONING BOARD OF APPEALS – ELECTRONIC MEETING

Notice is hereby given, that there will be a meeting of the Zoning Board of Appeals to be held at the City of Berkley in the Council Chambers, 3338 Coolidge, Berkley, Michigan on Monday, July 12, 2021 at 7:03 p.m. or as near thereto as the matter may be reached.

Application Number PBA-06-21
Jim Terbrueggen, on behalf of Scott Merian, 3497 Tyler, Parcel #25-07-451-034, west side of Tyler Ave north of Twelve Mile Rd, is requesting three (3) dimensional variances: 1) to construct an addition on a non-conforming structure that does not meet the required side yard setback; 2) to construct an addition on a non-conforming structure that encroaches into the required minimum 15 ft. separation distance; and, 3) the dwelling and garage improvements will exceed the maximum lot coverage.

  1. The addition to the non-conforming single-family dwelling is proposed to be 4 ft. from the north property line.
  2. The addition to the non-conforming single-family dwelling is proposed to be 12 ft. 8 in. from adjacent dwelling to the north and 13 ft. 3 in. adjacent from the dwelling to the south.
  3. The addition to the dwelling and the new garage is proposed to cover 41% of the residential lot.
Berkley City Code
  1. Berkley City Code, Chapter 138 Zoning, Article V, Division 17, Sec.138-526, Schedule of Regulations table requires minimum 5 ft. side yard setback in the R-1D District. The homeowner is requesting a 1 ft. side yard setback variance for the proposed addition.
  2. Berkley City Code, Chapter 138 Zoning, Article V, Division 17, Sec.138-527(d), Notes to Schedule of Regulations requires a minimum separation distance of at least 15 feet between dwellings. The homeowner is requesting a 2 ft. 4 in. separation distance for the proposed addition to adjacent dwelling to the north, and a 1 ft. 9 in. separation distance for the proposed addition to adjacent dwelling to the south.
  3. Berkley City Code, Chapter 138 Zoning, Article V, Division 17, Sec.138-526, Schedule of Regulations table limits the area of all structures to 35% lot coverage.
Comments on the above variance request may be made in person on the night of the meeting or in writing. All written comments must be in the hands of the Berkley Building Department before 6:00 p.m. on the date of the Public Hearing.

NOTICE OF PUBLIC HEARING
BERKLEY CITY PLANNING COMMISSION

A Public Hearing will be held by the Berkley City Planning Commission on Tuesday, July 27, 2021, at 7:05 p.m. or as near thereto as the matter may be reached in a public meeting at the City Hall Council Chambers, 3338 Coolidge, Berkley, Michigan. The Planning Commission shall hold a public hearing to consider the following:

AMEND SECTION 138-192 PROJECTIONS.
The Planning Commission will be discussing amending Section 138-192 Projections, in order to clarify that the total of all projections shall not exceed 30 percent of that walls’ surface area pertains to projections into a required setback.

AT THE CONCLUSION OF THE PUBLIC HEARING, the City Planning Commission will make a recommendation to the City Council regarding the proposed ordinance. The City Council will hear the proposed ordinance in two separate public meetings and shall have final authority for adoption.

BERKLEY CITY PLANNING COMMISSION

A Public Hearing will be held by the Berkley City Planning Commission on Tuesday, July 27, 2021 at 7:07 p.m. or as near thereto as the matter may be reached in a public meeting at the City Hall Council Chambers, 3338 Coolidge, Berkley, Michigan. The Planning Commission shall hold a public hearing to consider the following amendments:

AMEND SECTION 138-32 DEFINITIONS; AMEND SECTION 138-417 PRINCIPAL PERMITTED USES IN THE DOWNTOWN DISTRICT.

The Planning Commission will be discussing adding Entertainment Establishments to Section 138-32
Definitions and adding Entertainment Establishments as a permitted use in Section 138-417 in the Downtown District.
